i agree the copyrights need to be changed..
i justify piracy in the way of downloading i.e a game to try it out for a few days before actually going out and buying it... it feels stupid spending my hard earned money on something i might not like... and demo's dont even come close to the real game experience.. id have to say the same applies for movies, and music (listen to one good song/watch the movie for a few minutes, then decide to go buy it.. if not, just bin the stuff
prices are too high to just pick something out of random which will most likely dissapoint u...

There are two forces at work in copying intellectual property. First, you have the company that wants to make a profit from their hardwork in producing their software, films, music, etc. Then you have the consumer that wants the product at a reasonable price.

Copyright laws have a flaw in them as they are right now. First, they allow a company to have a monopoly on a good. This is really bad for supply and demand markets. This means no matter the demand, the supply will always be the same. This leads to consumers being ripped off. Second, copyright laws are giving by years. This leads to companies trying to get the most profit in the smallest amount of time.

Solution to copying and sharing intellectual property is to change the copyright laws.
I suggest that companies get monopoly rights to their intellectual property based on money, instead of time. Say they automaticly get their patent until they either make 10 million dollars or until they make 10 times their production costs, which ever is more. Also, their would be no time limit on how long they can hold a patent, unless the company doesn't produce the product to be sold. After this, companies lose intellectual property rights and may produce their product, along with every other company that wants to produce the disks. The intellectual property is in the public domain and anyone can copy, share, and distribute the property. Also, public domain property can be used to make other property and share the knowledge.

This would make companies not use copyright laws as monopolies, instead they would price their product without ripping off the consumer and still make a profit.

what if I ate grapes that were severely overpriced from a friends place who was growing the same from a sapling he bought from the vineyard... thereby he felt he had complete ownership of the grapes that grow from that sapling and decided to distribute it amongst his friends....and neighbours.... and strangers...... etc

OGW, in my opinion the grape rationalization will fall apart if a significant number of people all converge on the grape display at the same time, and test drive the grape. Unfortunately, it is human nature too push the envelope until it explodes.

Sir, we have different views about ethics and even though I donot agree with what you have written, I will respect your view even though it is a dangerous one. In some countrys, by law, your stated action could cause you to lose you hand. Where I grew up, you'd most likely get your A-- beaten, and in other countries. where I have been stationed, you could end up in jail or even worst, shot! The majority of the world do not take too lightly to strangers fingering, taking or in anyway fooling with their things. I am willing to bet that you have never been out of America.

Respect for other peoples property is a must! Lack of it causes WARs!!!!!!!!!!

Sir, my question to you is, did you take the grape and eat it in front of the store owner or did you wait until he/she was not looking?
Did you take it in front of a policeperson or did you make sure that they were not around?

The real issue here is morality, integrity what we know to be right and what we would want others to do if the positions were reverse. It has nothing to do with what one has or does not have. Each of us is responsible for or own actions and the plus or minus actions of the others is not a justification. It is only in this sense can our great country shine to all others as it should. If you don�t want other to take from you what is rightfully yours, then you should not take from others what is rightfully theirs!!!!!!!!!!!!!!!!!!!!!!

Every example you just cited is "ILLEGAL", it is a "CRIME", a "CRIMINAL ACT", you can be arrested, indicted, jailed, SHOT?

Downloading (copywrighted material for personal use, & of couse you didn't hack into someone's data base) is not in, & of itself illegal, however you create for yourself potential liability, & risk being sued in civil court for (monetary) damages

A better example is, I took a picture of Michael Jackson in his back yard w/ a telephoto lens, While this is not illegal, If sell the picture, & it is printed in magazines, Michael can make a case that I "profited" on his public image w/out his permission, & sue to recover damages (money)

There are enough laws on the books, without people thinking that things are illegal, when in fact, they are not

I am going to issue the challenge again, cite (1) example of anyone being arrested, or being charged w/ a crime (CRIMINAL COURT) for DOWNLOADING ONLY

w/out selling
w/out distributing
w/out P2P
w/out making a PROFIT from it

I AM saying it is not ILLEGAL anywhere in the United States of America

You park your car in a public parking space. I have a key that can open your car so I take it. I'm justified because you make a lot more than I do. I have a family to feed and taken your car means I do not have to buy one from a car dealer that has a lot more than I do.

Or maybe I'm a computer whizz tnat works in a bank. So I write a program to scamm one cent off of each ten dollars worth of transactions make with the bank.

We all hope that we never lose our wallet or Pocket Book, and we all hope that should that happen, that the person that finds it will have the morality to return it and ALL of its contents. Yet, we can give every excuse for stealing ourselves.

We are like drivers that speed so long as we do not see the Police. Soneone has to be watching in order for us to do the right thing.

To all that say coping (Downloading) without paying should be OK or that everything on the enternet should be free, will you freely state publicly what you downloaded and identify yourself to the proponet of the material?

Seems perfectly normal that theyre changing the dictionary....the english language has always been changing; as ye old english be sounding different to english a hundred years later. If the language changes so be it law speak has remained almost unchanged, reading legal papers is always so difficult because its almost completely precise in its meaning and the only question to law speak is applying it to real life situations.

Brian Stewart said it isn't up to me to interpet the law, it is up to judges, this is only true if the person being sued, or on trial agrees to a "bench trial"

In this country you have a right to a trial by a jury of your peers (criminal, or civil)

In a U.S. court the "people" (jurors) determine guilt, Judges just hand out the sentence, or fine

&, why would I have to rationalize something I don't do?

Also, I have a "bone to pick" w/ people calling the simple act of downloading copywrighted material "piracy", that is PURE RIAA HORSEs**t

They are trying to change the definition of the word, & people are letting them

DId you know if the majority of people use a word wrong for enough years they change the Dictionary?

Kinda like "ebonics" (changing the school lesson plans in southern california to allow for street slang), on a national scale

"Pirating" is selling copywrighted material for MONEY
